Agreement to these terms

These Terms of Service ("Terms") apply to your use of made-the-cut.com (the "Site"), Made the Cut's content on any platform, and any apps, integrations, or services we provide (together, the "Services"). Made the Cut is an independent project run personally by Max ("Made the Cut," "we," "us," or "our"). By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

Reviews are opinions

Our reviews, videos, and recommendations reflect our honest, personal experience with products in our own home. They are opinions, not professional, medical, safety, financial, or legal advice. Your results may differ. Always read the manufacturer's instructions and warnings, and consult a qualified professional where appropriate, especially for health, wellness, and child-related products.

Affiliate links & sponsorships

As an Amazon Associate we earn from qualifying purchases. Some links on the Site and in our content are affiliate links, which means we may earn a commission at no extra cost to you. Some content is sponsored or made in exchange for payment or free products. We disclose these relationships clearly, as required by the FTC's Endorsement Guides and platform rules. Compensation never guarantees a positive review.

Third-party sites & products

The Services link to websites, stores, and platforms we don't own or control, such as Amazon, Instagram, TikTok, and YouTube. Prices, availability, and product details are set by those third parties and can change at any time. Any purchase you make is between you and the seller, and your use of a third-party site is governed by its own terms and privacy policy. We are not responsible for third-party products, services, or content.

Our content

The text, photos, videos, logos, and design of the Services are owned by Made the Cut or our licensors and protected by copyright and other laws. You may view and share links to our content for personal, non-commercial purposes. You may not copy, republish, sell, or use our content commercially (including in advertising) without our written permission, except as granted to a brand partner in a signed agreement. "Made the Cut" and the MTC mark are our trademarks.

What you send us

If you send us product suggestions, feedback, comments, or ideas, you confirm you have the right to share them, and you allow us to use them to improve and create content without owing you anything. Please don't send confidential information unless we've agreed in writing to keep it confidential.

Brand partnerships

Information on the Site about how we work with brands is a general description, not an offer or a binding contract. Every paid partnership is governed by a separate written agreement or accepted proposal covering scope, fees, deliverables, timelines, and usage rights. If that agreement conflicts with these Terms, the agreement controls. Unless a written agreement says otherwise:

• We decide independently whether a product "made the cut," and we never promise a positive review.
• Fees for product purchase and evaluation are non-refundable once testing has begun.
• Usage rights to finished content transfer only after full payment.
• All sponsored content will carry the disclosures required by law and platform policy.

Apps & connected platforms

Some Services may connect to third-party platforms (for example Instagram, Facebook, TikTok, YouTube, or Amazon) through their official APIs. If you authorize such a connection, you allow us to access the data covered by the permissions you approve, and only to provide the related feature, as described in ourPrivacy Policy. You can revoke access at any time in that platform's settings. Your use of each platform remains subject to that platform's own terms, including theYouTube Terms of Service,Meta Terms of Service,TikTok Terms of Service, andAmazon Conditions of Use. We are not affiliated with or endorsed by any of these platforms. We may change or discontinue any integration at any time.

Acceptable use

You agree not to:

• Use the Services in a way that breaks the law or infringes anyone's rights.
• Scrape, copy, or harvest content or data from the Services in bulk, or use our content to train AI models, without permission.
• Interfere with, disrupt, or try to gain unauthorized access to the Services or their systems.
• Impersonate Made the Cut or misrepresent a relationship with us.
• Send spam, malware, or abusive messages.

Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee that the Services will be uninterrupted or error-free, or that any product will perform for you the way it did for us.

Limitation of liability

To the fullest extent permitted by law, Made the Cut will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services or any product you buy based on our content. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $100. Some jurisdictions don't allow these limits, so they may not fully apply to you.

Indemnification

You agree to indemnify and hold harmless Made the Cut from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services or your violation of these Terms.

Disputes

If you have a concern, please email us first. Most issues can be resolved quickly and informally. If we can't resolve a dispute within 30 days, either party may bring it in the state or federal courts located in the Commonwealth of Massachusetts, and both parties consent to the jurisdiction of those courts. These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable U.S. federal law, without regard to conflict-of-law rules. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

General

• Changes. We may update these Terms. We'll change the "Last updated" date above, and continued use of the Services means you accept the updated Terms.
• Termination. We may suspend or end access to the Services for anyone who violates these Terms.
• Severability. If any part of these Terms is unenforceable, the rest stays in effect.
• No waiver. Not enforcing a provision isn't a waiver of our right to do so later.
• Entire agreement. These Terms, the Privacy Policy, and any signed partnership agreement are the whole agreement between you and us about the Services.
